1. Program Overview
These SMS Terms & Conditions (the “Terms”) govern your participation in the Nexus One Financial Advisors mobile messaging program (the “Program”). By enrolling in or otherwise consenting to receive text messages from Nexus One Financial Advisors (“Nexus One,” “we,” “us,” or “our”), you agree to these Terms.
Program Description: The Program delivers service-related text messages only—such as appointment confirmations and reminders, service notifications, account-servicing notices, market commentary or alerts, and responses to your specific requests. The Program does not send advertising or promotional messages unless you separately provide the required express written consent for marketing communications.
2. Consent and Enrollment (Opt-In)
You may enroll in the Program by providing your mobile number and consenting to receive text messages via one or more of the following methods (as implemented by Nexus One):
- Submitting a web form that includes a clear SMS consent checkbox and related disclosures;
- Signing a paper or electronic agreement that includes SMS consent;
- Texting a designated keyword (e.g., “START”) to Nexus One after receiving disclosures; or
- Providing consent during a recorded phone interaction or secure portal workflow that captures your affirmative agreement.
By opting in, you represent that you are the current subscriber or customary user of the mobile number provided and that you have the authority to consent to receive messages at that number. Consent is not required to obtain services from Nexus One. Standard message and data rates may apply.
3. Message Frequency
Message frequency will vary based on your interactions and requested services. In general, you should expect variable frequency, including periods with no messages. If Nexus One introduces any recurring marketing programs, those will require a separate opt-in and will include a specific frequency disclosure (e.g., “up to X msgs/month”).
4. Costs
Message and data rates may apply to any messages exchanged with us. Check your mobile plan and contact your wireless provider for details.
5. Opt-Out (STOP Commands)
You can cancel the SMS service at any time by replying STOP. You may also use recognized stop commands such as END, CANCEL, UNSUBSCRIBE, or QUIT. After you send a stop command, we will send a confirmation message and you will no longer receive Program messages from that short code or long code. To rejoin, provide a new opt-in or contact us using the support information below.

7. Delivery and Carrier Liability
Delivery of messages is subject to effective transmission by your wireless carrier and compatible device. Carriers are not liable for delayed or undelivered messages. Message delivery may be impacted by network coverage, device settings, or other technical limitations.
8. Privacy and Data Use
We collect, use, and retain information in connection with the Program as described in our Privacy Policy, including your mobile number, message content, and related metadata. No mobile opt-in data will be shared with third parties or affiliates.
9. Number Ownership and Changes
You agree to notify us immediately if you change, transfer, or deactivate your mobile number. Your consent applies only to the specific number you provided; messages intended for you may be sent to a reassigned number if you fail to notify us of the change.
10. Appropriate Use and Sensitive Information
Do not send or include sensitive personal information via SMS, such as full account numbers, Social Security numbers, driver’s license numbers, payment card details, passwords, or medical/health information. SMS is not a secure channel for transmitting confidential information.
11. Financial Disclosures
Messages delivered through the Program are for informational purposes only and do not constitute investment advice, an offer, or a solicitation to buy or sell any security or financial product. Any investment decisions should be based on your individual circumstances and made after reviewing appropriate disclosures and agreements.
12. Changes to the Program or These Terms
We may modify or terminate the Program or these Terms at any time. If we make material changes, we will provide notice by updating these Terms and/or by other reasonable means. Your continued participation in the Program after changes become effective constitutes your acceptance of the changes.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of [State], without regard to its conflict of laws principles. Any disputes arising out of or relating to the Program or these Terms will be resolved in the state or federal courts located in [County], [State], unless otherwise required by applicable law. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXUS ONE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR PARTICIPATION IN THE PROGRAM.
